Two routes to grant it

Choose based on whether there is a Guatemalan notary near you.

Route 1: Guatemalan notary in your city

Signed under Guatemalan law and in Spanish. No apostille and no translation needed. The fastest route.

Route 2: local notary public + apostille

Apostilled by the competent authority (in the US, the Secretary of State). If it is in English, it is translated in Guatemala by a sworn translator.

Not sure about the apostille? See apostille for Guatemala.

Types

Which power of attorney do you need?

General

For the ordinary management of your affairs: collections, payments, administration of property.

Special

For specific acts, such as selling a particular property or taking part in an inheritance.

With representation

The attorney-in-fact acts in your name and the effects fall directly on you.

Without representation

The attorney-in-fact acts in their own name and then transfers the effects to you.

Three mistakes that force you to start over

Missing powers

A generic power of attorney may not include, for example, the power to accept an inheritance or sell a specific property.

Apostille in the wrong place

The apostille must be issued by the competent authority for the place where you signed.

Sending without review

Always send us a scan first. Repeating the process costs time and money.

Questions

Frequently asked questions

What is a mandato in Guatemala?

It is the Guatemalan power of attorney: a public deed by which you authorize another person to carry out one or more acts on your behalf. It is registered in the Electronic Registry of Powers of Attorney so notaries, registries and courts can verify it.

General or special power of attorney?

A general mandato covers the ordinary management of your affairs, such as collections, payments and administration. A special mandato is limited to specific acts, such as selling a particular property.

Can I grant it if I live in the United States?

Yes. Before a Guatemalan attorney-notary practicing in your city, with no apostille or translation needed; or before a local notary public, with an apostille from the Secretary of State and, if it is in English, a sworn translation in Guatemala.

Who drafts the power of attorney?

The notary before whom you sign. We step in afterwards: we review the document, protocolize it if needed and register it in Guatemala.

How long does registration take?

About 36 hours from when we have the complete documentation, signed and, where applicable, apostilled and translated.

Is a US power of attorney in English valid in Guatemala?

It can be used if it is apostilled and translated into Spanish by a sworn translator in Guatemala, then protocolized. It must also include the specific powers the procedure requires.

How is a power of attorney revoked?

By a public deed of revocation, which is also registered in the Electronic Registry of Powers of Attorney. It is advisable to notify the attorney-in-fact.
